The Norwegian Lithuanian Chamber of Commerce informs that business which experience difficulties due to COVID-19 circumstances may apply for Certificates of Force Majeure in accordance with established procedures. Certificates of Force Majeure are issued by Vilnius, Kaunas, Klaipėda, Šiauliai and Panevėžys Chamber of Commerce, Industry and Crafts depending on territory of your business.

The Certificates of Force Majeure may be used by the parties as evidence of contractual obligations or civil liability.

The Norwegian Lithuanian Chamber of Commerce reminds that a partner who needs to obtain a Certificate of Force Majeure has either directly or remotely submit the documents to territorial Chamber of Commerce, Industry and Crafts within a reasonable time after the occurrence of force majeure circumstances that can determine the fact of force majeure existence. Norwegian Lithuanian Chamber of Commerce or Lawyers may help or to intermediate to submit documents.

Procedure of issuing the Certificates of Force Majeure:

1. Certificates of Force Majeure will be issued if such circumstances have occurred and existed in the territory of the Republic of Lithuania.

2. Certificates of Force Majeure will be issued to the Company is established by the laws and carrying out commercial and economic activities.

3. To obtain a Certificate of Force Majeure the Company should submit the following documents:

· application to the General director of the Chamber of Commerce, Industry and Crafts. Application should be signed by the Chief executive officer (CEO) or by the Company’s Owner or their authorized representatives;

· the contract and its attachments according to which the obligations were not executed due to force majeure circumstances;

· documents issued by the competent institutions that provides the existence of force majeure circumstances;

· documents certifying that the other party was immediately informed about the existence of force majeure circumstances;

· documents which proves the extent of contractual obligations due to force majeure circumstances;

· a document which confirms the paid fee to the Chamber of Commerce, Industry and Crafts;

· other necessary supporting documents.

4. decision to issue the Certificate of Force Majeure is made within 20 working days of receiving the application day.

5. a Certificate of Force Majeure is issued if the documents submitted by the Company prove the circumstances and conditions which exempt from liability according to force majeure.

6. At the request of the Company the Chamber of Commerce, Industry and Crafts may take steps to determine the existence of force majeure circumstances.

7. If the documents submitted by the Company or the facts determined by the Chamber of Commerce, Industry and Crafts do not prove the circumstances and conditions provided in Paragraph 5 of this Procedure, the motivated refusal to issue the Certificate of Force Majeure to the legal person is issued.

8. The Certificate of Force Majeure shall be entered on the Chamber of Commerce, Industry and Crafts form. It shall contain the number and date, name and address of the Company submitted the application, the parties of the contract, the place where the contract is concluded, the circumstances of force majeure, the period for which they exist and the documents which was submitted.

9. The Certificate of Force Majeure shall be signed by the General director of the Chamber of Commerce, Industry and Crafts or his authorized person and stamped
